## Abstract

The present application relates to probiotic confection-based compositions comprising lactic acid-producing bacteria and oil-based compositions comprising the same.

## Claims

### Claim 1

A probiotic confection-based composition comprising a confection and isolated Bacillus coagulans bacteria, wherein said confection comprises chocolate, and wherein said composition comprises a coating of isolated Bacillus coagulans bacteria on the exterior surface of said probiotic confection-based composition, wherein at least 90% of said isolated Bacillus coagulans bacteria are in the form of spores.

### Claim 2 (depends on 1)

The probiotic confection-based composition of claim 1, wherein said isolated Bacillus coagulans bacteria have been applied to the exterior of said confection by spray-drying or in a powder.

### Claim 3 (depends on 1)

The probiotic confection-based composition of claim 1, wherein said confection has been soaked in a solution containing said isolated Bacillus coagulans bacteria.

### Claim 4 (depends on 1)

The probiotic confection-based composition of claim 1, wherein said isolated Bacillus coagulans bacteria are micro-encapsulated.

### Claim 5 (depends on 1)

The probiotic confection-based composition of claim 1, wherein said confection-based composition further comprises fudge, marshmallow, or toffee.

### Claim 6 (depends on 5)

The probiotic confection-based composition of claim 5, further comprising an isolated Bacillus coagulans spore inside said probiotic confection-based composition.

### Claim 7 (depends on 1)

The probiotic confection-based composition of claim 1, wherein said confection-based composition further comprises one or more of:
(a) sucrose;
(b) dextrose;
(c) lactose;
(d) honey;
(e) malt syrup;
(f) maltose;
(g) fructose;
(h) maple syrup;
(i) rice syrup;
(j) sorghum syrup;
(k) refiners syrup;
(l) high fructose corn syrup; and
(m) molasses.

### Claim 8 (depends on 1)

The probiotic confection-based composition of claim 1, wherein said confection-based composition further comprises cane sugar, beet sugar, date sugar, or an artificial sweetener.

### Claim 9 (depends on 1)

The probiotic confection-based composition of claim 1, wherein at least 95% of said isolated Bacillus coagulans bacteria are in the form of spores.

### Claim 10 (depends on 1)

The probiotic confection-based composition of claim 1, wherein isolated Bacillus coagulans spores retain the ability to germinate at physiological conditions for at least about 1 month to about 18 months.

### Claim 11 (depends on 1)

The probiotic confection-based composition of claim 1, further comprising an isolated Bacillus coagulans spore inside said probiotic confection-based composition.

### Claim 12 (depends on 1)

The probiotic confection-based composition of claim 1, wherein said isolated Bacillus coagulans bacteria comprise between 0.01% and 10% by weight of said probiotic confection-based composition.

### Claim 13 (depends on 1)

The probiotic confection-based composition of claim 1, wherein said isolated Bacillus coagulans bacteria is Bacillus coagulans hammer strain Accession No. ATCC 31284.

### Claim 14 (depends on 1)

The probiotic confection-based composition of claim 1, wherein said isolated Bacillus coagulans bacteria is selected from the group consisting of GBI-30 strain (ATCC Designation Number PTA-6086), GBI-20 strain (ATCC Designation Number PTA-6085), and GBI-40 strain (ATCC Designation Number PTA-6087).

### Claim 15 (depends on 1)

The probiotic confection-based composition of claim 1, wherein said isolated Bacillus coagulans bacteria is derived from Bacillus coagulans hammer strain Accession No. ATCC 31284.

### Claim 16 (depends on 1)

The probiotic confection-based composition of claim 1, wherein said probiotic confection-based composition has been stored at room temperature.

### Claim 17 (depends on 16)

The probiotic confection-based composition of claim 16, wherein isolated Bacillus coagulans spores have retained the ability to germinate at physiological conditions for at least about 12 days.

### Claim 18 (depends on 1)

The probiotic confection-based composition of claim 1, wherein isolated Bacillus coagulans spores are present on the exterior surface of said probiotic confection-based composition at a concentration of about 1×105 to about 1×1013 per gram of said confection.
