## Abstract

Brachytherapy radioisotope carrier systems and methodology for providing real-time customized brachytherapy treatment to subjects with tumors difficult to control using conventional radiation therapy techniques. The invention generally relates to devices, methods and kits for providing customized radionuclide treatments, to help cure, slow progression or regrowth, or ameliorate the symptoms associated with tumors.

## Claims

### Claim 1

A treatment apparatus comprising:
a plurality of substantially rectangular flap portions;
a plurality of petal portions each having
a first end at least partially coupled to one or more of the plurality of flap portions, and
a second substantially rounded end opposite the first end; and
a radioactive seed embedded in each of the petal portions;
wherein the petal portions are positioned in an offset arrangement with reference to the flap portions such that, at a proximal end of the treatment apparatus, a first of the plurality of flap portions extends beyond a first of the plurality of petal portions nearest the proximal end of the treatment apparatus and, at a distal end of the treatment apparatus, a second of the plurality of petal portions extends beyond a second of the plurality of flap portions nearest the distal end of the treatment apparatus;
wherein the treatment apparatus is substantially flexible and is configured for flexing such that the first flap portion at the proximal end of the treatment apparatus is adjacent to the second petal portion at the distal end of the treatment apparatus such that a treatment surface is exposed on an outer cylindrical surface formed by the flexed treatment apparatus, the treatment apparatus configured for at least partial placement in a cavity of a mammal to apply radioactive energy from the seeds to at least some mammalian tissue forming the cavity.

### Claim 2 (depends on 1)

The treatment apparatus of claim 1, wherein the petal portions are substantially flexible such that the substantially rounded ends flex inward towards a central longitudinal axis within the cylindrical surface formed by the flexed treatment apparatus.

### Claim 3 (depends on 1)

The treatment apparatus of claim 1, further comprising a plurality of perforations between adjacent flap portions in order to further enable flexing of the treatment apparatus.

### Claim 4 (depends on 1)

The treatment apparatus of claim 1, wherein a thickness between the treatment surface and a non-treatment surface is between about 1 and 5 millimeters.

### Claim 5 (depends on 1)

The treatment apparatus of claim 1, wherein the radioactive seeds are positioned closer to a non-treatment surface of the petal portions than to the treatment surface of the petal portions.

### Claim 6 (depends on 1)

The treatment apparatus of claim 1, wherein the flap portions are substantially square.

### Claim 7 (depends on 1)

The treatment apparatus of claim 1, further comprising a radioactive seed embedded in each of the flap portions.

### Claim 8 (depends on 7)

The treatment apparatus of claim 7, wherein the flap portions are elongated rectangular in shape, such that a longitudinal axis of the flap portions is about twice or more a longitudinal axis of respective petal portions.

### Claim 9 (depends on 8)

The treatment apparatus of claim 8, wherein each of the flap portions includes a second radioactive seed embedded in the flap portion.

### Claim 10 (depends on 1)

The treatment apparatus of claim 1, further comprising:
a substrate shaped substantially similar to an outer surface of the combined plurality of petal portions and flap portions and attached to at least the treatment surface of the flap portions, the substrate including a therapeutic agent.

### Claim 11 (depends on 10)

The treatment apparatus of claim 10, wherein the therapeutic agent comprises one or more of gamma particles, beta particles, alpha particles, chemotherapy agent, tumoricidal agent, viral vector agent, or immunotherapeutic agent.

### Claim 12

A treatment apparatus comprising:
a first plurality of substantially semi-hemispherical petal portions;
a second plurality of substantially semi-hemispherical petal portions, wherein the first petal portions are coupled to the second petal portions, the first petal portions positioned in an offset arrangement with reference to the second petal portions such that, at a proximal end of the treatment apparatus, a first of the first plurality of petal portions extends beyond a first of the second plurality of petal portions nearest the proximal end of the treatment apparatus and, at a distal end of the treatment apparatus, a second of the second plurality of petal portions extends beyond a second of the first plurality of petal portions nearest the distal end of the treatment apparatus; and
a radioactive seed embedded in each of the first plurality of petal portions;
wherein the treatment apparatus is substantially flexible and is configured for flexing such that the first petal portion of the first plurality of petal portions at the proximal end of the treatment apparatus is adjacent to the second petal portion of the second plurality of petal portions at the distal end of the treatment apparatus such that treatment surfaces of the first and second plurality of petal portions are exposed on an outer surface formed by the flexed treatment apparatus, the treatment apparatus configured for at least partial placement in a cavity of a mammal to apply radioactive energy from the seeds to at least some mammalian tissue forming the cavity.

### Claim 13 (depends on 12)

The treatment apparatus of claim 12, wherein each of the first plurality of petal portions are substantially flexible such that the first plurality of petal portions are foldable towards a central axis of the flexed treatment apparatus and each of the first plurality of petal portions contacts a portion of at least one other non-adjacent of the first plurality of petal portions.

### Claim 14 (depends on 13)

The treatment apparatus of claim 13, wherein each of the second plurality of petal portions are substantially flexible such that the second plurality of petal portions are foldable towards the central axis of the flexed treatment apparatus and each of the second plurality of petal portions contacts a portion of at least one other non-adjacent of the second plurality of petal portions and the treatment apparatus is substantially spherical in shape.

### Claim 15 (depends on 12)
