## Abstract

A novel romaine lettuce cultivar, designated Valley Fresh, is disclosed. The invention relates to the seeds of lettuce cultivar Valley Fresh, to the plants of lettuce cultivar Valley Fresh and to methods for producing a lettuce plant by crossing the cultivar Valley Fresh with itself or another lettuce cultivar. The invention further relates to methods for producing a lettuce plant containing in its genetic material one or more transgenes and to the transgenic plants produced by that method and to methods for producing other lettuce cultivars derived from the cultivar Valley Fresh.

## Claims

### Claim 1

A seed of lettuce cultivar Valley Fresh, representative sample seed of said cultivar was deposited under ATCC Accession No. PTA-9438.

### Claim 2 (depends on 1)

A lettuce plant, or a part thereof, produced by growing the seed of claim 1.

### Claim 3 (depends on 2)

A tissue culture produced from protoplasts or cells from the plant of claim 2, wherein said cells or protoplasts of the tissue culture are produced from a plant part selected from the group consisting of leaf, pollen, embryo, cotyledon, hypocotyl, meristematic cell, root, root tip, pistil, anther, flower, shoot, stem, seed, and petiole.

### Claim 4 (depends on 3)

A lettuce plant regenerated from the tissue culture of claim 3, wherein the plant has all of the morphological and physiological characteristics of cultivar Valley Fresh.

### Claim 5 (depends on 2)

A method for producing a lettuce seed comprising crossing two lettuce plants and harvesting the resultant lettuce seed, wherein at least one lettuce plant is the lettuce plant of claim 2.

### Claim 6 (depends on 5)

A lettuce seed produced by the method of claim 5.

### Claim 7 (depends on 6)

A lettuce plant, or a part thereof, produced by growing said seed of claim 6.

### Claim 8 (depends on 2)

A method of producing a male sterile lettuce plant wherein the method comprises transforming the lettuce plant of claim 2 with a nucleic acid molecule that confers male sterility.

### Claim 9 (depends on 8)

A male sterile lettuce plant produced by the method of claim 8.

### Claim 10 (depends on 2)

A method of producing an herbicide resistant lettuce plant wherein the method comprises transforming the lettuce plant of claim 2 with a transgene wherein the transgene confers resistance to an herbicide selected from the group consisting of imidazolinone, sulfonylurea, glyphosate, glufosinate, L-phosphinothricin, triazine and benzonitrile.

### Claim 11 (depends on 10)

An herbicide resistant lettuce plant produced by the method of claim 10.

### Claim 12 (depends on 2)

A method of producing a pest or insect resistant lettuce plant wherein the method comprises transforming the lettuce plant of claim 2 with a transgene that confers pest or insect resistance.

### Claim 13 (depends on 12)

A pest or insect resistant lettuce plant produced by the method of claim 12.

### Claim 14 (depends on 13)

The lettuce plant of claim 13, wherein the transgene encodes a Bacillus thuringiensis endotoxin.

### Claim 15 (depends on 2)

A method of producing a disease resistant lettuce plant wherein the method comprises transforming the lettuce plant of claim 2 with a transgene that confers disease resistance.

### Claim 16 (depends on 15)

A disease resistant lettuce plant produced by the method of claim 15.

### Claim 17 (depends on 2)

A method of producing a lettuce plant with a value-added trait, wherein the method comprises transforming the lettuce plant of claim 2 with a transgene encoding a protein selected from the group consisting of a ferritin, a nitrate reductase, and a monellin.

### Claim 18 (depends on 17)

A lettuce plant with a value-added trait produced by the method of claim 17.

### Claim 19

A method of introducing a desired trait into lettuce cultivar Valley Fresh wherein the method comprises:
(a) crossing a Valley Fresh plant, wherein a representative sample of seed was deposited under ATCC Accession No. PTA-9438, with a plant of another lettuce cultivar that comprises a desired trait to produce progeny plants wherein the desired trait is selected from the group consisting of male sterility, herbicide resistance, insect or pest resistance, modified bolting and resistance to bacterial disease, fungal disease or viral disease;
(b) selecting one or more progeny plants that have the desired trait to produce selected progeny plants;
(c) crossing the selected progeny plants with the Valley Fresh plants to produce backcross progeny plants;
(d) selecting for backcross progeny plants that have the desired trait and all of the physiological and morphological characteristics of lettuce cultivar Valley Fresh listed in Table 1; and
(e) repeating steps (c) and (d) three or more times in succession to produce selected fourth or higher backcross progeny plants that comprise the desired trait and all of the physiological and morphological characteristics of lettuce cultivar Valley Fresh listed in Table 1.

### Claim 20 (depends on 19)

A lettuce plant produced by the method of claim 19, wherein the plant has the desired trait.

### Claim 21 (depends on 20)

The lettuce plant of claim 20, wherein the desired trait is herbicide resistance and the resistance is conferred to an herbicide selected from the group consisting of imidazolinone, sulfonylurea, glyphosate, glufosinate, L-phosphinothricin, triazine and benzonitrile.

### Claim 22 (depends on 20)

The lettuce plant of claim 20, wherein the desired trait is insect or pest resistance and the insect or pest resistance is conferred by a transgene encoding a Bacillus thuringiensis endotoxin.
