A pivotal bone anchor assembly includes a receiver having an open channel for receiving a rod and a central bore with a lower interior recess, a lower opening, and an internal support surface adjacent to and above the lower opening. The assembly also includes a retaining structure having a center opening and a discontinuous inner support surface, with the retaining structure being initially positionable into the lower interior recess of the central bore of the receiver. The assembly further includes a shank with a spherical head that is positionable into the retaining structure, with the inner support surface of the retaining structure being configured to exert a frictional drag force on the spherical head of the shank to resist rotation and articulation of the shank relative to the receiver in a non-locked configuration.
