A pivotal bone anchor assembly includes a receiver, a bone anchor, and an open retainer. The receiver has an upper portion with a channel for receiving a rod and a lower portion with an internal chamber having a seating surface adjacent a bottom opening. The bone anchor has a partial spherically shaped head with a hemisphere plane and an anchor portion for attachment to a bone of a patient. The open retainer is configured for positioning in a lower region of the internal chamber in engagement with the seating surface and for capturing the head of the bone anchor therein. The open retainer further comprises a base portion and a plurality of flexible members extending upwards from the base portion so as to grip the head of the bone anchor above the hemisphere plane to provide a pre-lock friction fit arrangement between the receiver and the bone anchor prior to locking the assembly with the closure top.
