Method and apparatus for selecting a transmission resource

An apparatus comprising:

• a transceiver that receives configuration information regarding a first set of resources;
• and
• a controller coupled to the transceiver, where the controller
• determines a second set of resources, and
• selects a transmission resource from the first set of resources or the second set of resources using a selection criterion,
• wherein the transceiver
• transmits a scheduling request if the transmission resource belong to the first set of resources, and
• transmits a data transport block if the transmission resource belongs to the second set of resources, and
• wherein the scheduling request comprises control information requesting resources for transmission of the data transport block,
• wherein the selection criterion is based on whether an uplink grant has granted resources for a subframe, and
• wherein the method further comprises selecting a transmission resource from the second set of resources if the transmission resource belongs to the subframe and if no uplink grant has granted resources for the subframe.
