## Abstract

Recombinant DNA molecules and constructs useful for modulating gene expression in plants, including molecules derived from Medicago truncatula sequences, are provided. plants, plant cells, plant parts, and seeds comprising recombinant DNA molecules operably linked to heterologous transcribable DNA molecules are further provided, as are methods of their use.

## Claims

### Claim 1

A recombinant DNA molecule comprising a DNA sequence selected from the group consisting of:
a) a DNA sequence comprising SEQ ID NO:3; and
b) a fragment comprising at least 200 contiguous nucleotides of SEQ ID NO:3, wherein the fragment has gene-regulatory activity;
wherein said DNA sequence is operably linked to a heterologous transcribable DNA molecule.

### Claim 2 (depends on 1)

The recombinant DNA molecule of claim 1, wherein said DNA sequence comprises SEQ ID NO:3.

### Claim 3 (depends on 1)

The recombinant DNA molecule of claim 1, wherein the heterologous transcribable polynucleotide molecule comprises a gene of agronomic interest.

### Claim 4 (depends on 3)

The recombinant DNA molecule of claim 3, wherein the gene of agronomic interest confers herbicide tolerance in plants.

### Claim 5 (depends on 3)

The recombinant DNA molecule of claim 3, wherein the gene of agronomic interest confers pest resistance in plants.

### Claim 6

A transgenic plant cell comprising a recombinant DNA molecule comprising a DNA sequence selected from the group consisting of:
a) a DNA sequence comprising SEQ ID NO:3; and
b) a fragment comprising at least 200 contiguous nucleotides of SEQ ID NO:3, wherein the fragment has gene-regulatory activity;
wherein said DNA sequence is operably linked to a heterologous transcribable DNA molecule.

### Claim 7 (depends on 6)

The transgenic plant cell of claim 6, wherein said transgenic plant cell is a monocotyledonous plant cell.

### Claim 8 (depends on 6)

The transgenic plant cell of claim 6, wherein said transgenic plant cell is a dicotyledonous plant cell.

### Claim 9

A transgenic plant, or part thereof, comprising a recombinant DNA molecule comprising a DNA sequence selected from the group consisting of:
a) a DNA sequence comprising SEQ ID NO:3; and
b) a fragment comprising at least 200 contiguous nucleotides of SEQ ID NO:3, wherein the fragment has gene-regulatory activity;
wherein said DNA sequence is operably linked to a heterologous transcribable DNA molecule.

### Claim 10 (depends on 9)

A progeny plant of the transgenic plant of claim 9, or a part thereof, wherein the progeny plant or part thereof comprises said recombinant DNA molecule.

### Claim 11 (depends on 9)

A transgenic seed of the transgenic plant of claim 9 wherein the transgenic seed comprises the recombinant DNA molecule.

### Claim 12 (depends on 9)

A method of producing a commodity product comprising obtaining a transgenic plant or part thereof according to claim 9 and producing the commodity product therefrom.

### Claim 13 (depends on 12)

The method of claim 12, wherein the commodity product is protein concentrate, protein isolate, grain, starch, seeds, meal, flour, biomass, or seed oil.

### Claim 14 (depends on 1)

A method of producing a transgenic plant comprising:
a) transforming a plant cell with the recombinant DNA molecule of claim 1 to produce a transformed plant cell; and
b) regenerating a transgenic plant from the transformed plant cell.
